If you are getting divorced in Thailand then you need to have a solicitor at your side. With many years of experience in Thailand we are best able to serve your needs. Here are the basics about divorce in Thailand and how best to obtain a divorce.

Getting divorced can be easy or complicated. If both parties agree then it can be very easy as both you and your wife simply have to go back to the Amphur’s Office where you got married and file for a divorce. Forms need to be completed and the procedure is rather simple. Child custody and any other financial agreements can be drafted and signed at the offices as it is a straight forward administrative divorce.

If one party does not agree then the matter has to be placed onto the court roll for hearing. This is where is can become expensive and time-consuming as the wheels of justice in Thailand rolls very slow. There are a number of reasons to file for a divorce however the most common would be adultery, or the husband has not lived with the wife for more than a year. Both parties need to be present in both an administrative divorce or one held in court.

Divorce especially when it comes to children will be an issue if one party wants to return back to his country. How would the access to the children work and also what financial arrangements would be made. Speak to one of our British solicitors about filling for divorce in Thailand and how best to manage the divorce. Complex divorces might include the use of a private detective and other services you might be thinking of right now.

Call us today on our toll-free US or UK telephone numbers or speak to us via live chat on our main website. Alternatively walk into any of our office in Bangkok, Phuket, Samui, Pattaya, Chiang Mai or Hua Hin.

Do it now!

If you have had a wedding in Thailand and now need to register your marriage in Thailand then speak to our solicitors about registration of the marriage. With years of experience we are best able to assist you. Speak to us today.

Firstly if you are not in Bangkok and are not using a solicitor then you would have to come to Bangkok for at least 2 days. Most people leave the documents with their solicitors and collect it 3 days later. You or your solicitor firstly have to go to your embassy in Bangkok to obtain a letter of affirmation. This letter states that you are able to get married and that you are single. If you have been divorced the embassy would want a divorce decree from you with the application. This affirmation takes 24 hours to obtain and this then needs to be verified by the Thai Department of Foreign Affairs.

The Thai Department of Foreign Affairs is out where the old Bangkok airport used to be in Laksi. This takes another day so if you want to do it yourself – go very early. They will verify the letter of affirmation and stamp on the back of the documents – verified. This letter now has to be taken to the local Amphur’s office which Westerns call the District Office. Here all the documentation has to be handed in and a Thai marriage certificate is given.

If you want to simplify your life then speak to any of our solicitors in Thailand about prenuptial agreements and marriage registration.

If you are wanting to retire in Thailand you need to obtain a retirement visa for Thailand. Our solicitors in Thailand will be able to show you how best to obtain this visa and what the requirements for a retirement visa is.

In order to retire in Thailand you need to be older than 50 years of age when you apply for the visa. The visa is applied for outside of Thailand at the Thai Embassy. This visa is called the “OA” Visa. This is a 3 month retirement visa. Once you enter Thailand you need to extend this visa at Thai Immigration in order to live in Thailand for 1 year. Over the past 3 years they have become strict with regards to age. Before they would allow you to apply for the 1 year visa even when you were 49 but turned 50 during the course of the visa. Today that has changed. You need to be 50 years when the application is made.

You need a medical certificate to show that you do not have a transmittable disease such as HIV/AIDS. You also need to show that you do not have a criminal record. This can be complicated as they do not appear to look at DUI as being criminal however it is best to speak to one of our solicitors in person about a DUI criminal record. You also need to show that you have the finance available when you retire.

The financial requirements are that you need to show 800,000 Baht in a Thai bank account or an income of at least 60,000 Baht a month. This normally for income requires you to obtain a letter from your embassy to show this income requirement. You can also show a combination of the two. If you are married to a Thai there is the option of applying for a marriage visa which also give you a year in Thailand however the financial requirements are much lower.

Speak to our solicitors about your options if you are over the age of 50 and wanting to retire in Thailand. Speak to us on our main website via live help, call our toll-free US or UK telephone numbers or simply walk into any of our offices in Thailand today.

Speak to our one of our solicitors about this today!

If you are married to a Thai citizen then you can obtain a marriage visa for Thailand. This visa is more complicated to apply for than a tourist visa however there are many benefits to this visa. These are the basics for the visa

When you are married to a Thai citizen you can apply for a marriage visa. This visa is valid for 3 months or 90 days when you enter Thailand. Some Thai Embassies will allow you to obtain a multiple entry visa which has 4 visa ‘legs’ stages. Each stage ia valid for 3 months or 90 days. When you enter Thailand you can stay for 90 days however just before the first leg expires you leave the country and do a ‘visa run’ – in other words you leave Thailand for a day and come back across the border. When you come back into Thailand the second leg is activated. You can again stay in Thailand for another 90 days.

There is also the option of a full one year extension in Thailand at Thai Immigration. This will allow you to stay in Thailand for 1 year without the need to leave the country. For this you need to be able to show that you meet the financial requirements and that you are in a valid relationship. Most people leave this legwork for a solicitor to do as you need to show where you live with a map showing where you live, photos of you and the wife together in the apartment or house and other documents. You also need to show an income of 40,000 Baht a month or a deposit in your Thai bank account of 400,000 Baht. This needs to be done each year.

The 3 month visa also allows you to apply for a work permit in Thailand. It’s the only visa that can easily be used for a work permit application outside of the usual business visa.

If you are planning on living in Thailand then speak to one of our solicitors about obtaining a Thai marriage visa for yourself. Let him advice you about what needs to be done, the paperwork needed and also explain to you about the 90 day reporting to immigration. Speak to us on our main website via our chat messenger, or via out toll-free US or UK telephone numbers or simply walk into any of our offices in Thailand.

Do it today!

Obtaining a Tourist Visa for Thailand today is easier than before as the requirements have been lowered. Before the embassies would not issue back to back tourist visa’s however that has since changed.

The tourist visa can only be used for the purposes of tourism in Thailand. When you apply for the visa you would have to leave your passport overnight at the Thai Embassy for the visa however many do process the visa for you while you wait. The Thai visa requirements are not that difficult to understand. Your visit has to be for tourism and you must have proof of your ability to support yourself in Thailand. The visa is usually a single entry visa which means that you can only use it once. When you enter Thailand you are allowed to stay for a maximum of 2 months. This can be extended at Thai Immigration for a fee of 1,900 Baht. This will allow you another 30 days stay in Thailand without the need to leave the country.

The tourist visa does not allow you to work in Thailand. If you are caught working while holding a tourist visa you will be arrested and deported. You can if you do find work change the tourist visa while in Thailand. This however is difficult and takes on average a month to change. Speak to one of our solicitors in Thailand about changing a tourist visa to apply for a work permit.

Should you have any questions about a visa for Thailand then speak to one of our solicitors about the purpose of the visit and how best to obtain your visa. Speak to us online on our main website, via our toll-free UK and US telephone numbers or walk into any of our offices in Thailand for free advice.
